Milestone Extension: Section 106 Review
Delay due to lapse in appropriations
Delay due to lapse in appropriations
As noted in the notes for the updates, FERC provided a revised EIS schedule on 2/28/19. Therefore, the revised milestone dates have been revised to accommodate that revised schedule. Therefore, the project sponsor should be aware of the date changes. There has been ongoing coordination regarding the need for schedule changes for this project due to the government shutdown so our CERPO and lead agency CERPO are aware of the issues and need for updated schedules.
The actions final milestone Baseline Date is incorrect. ESA Formal Consultation was initiated 7/14/2017, and the statute provides 135 days to complete the Biological Opinion.
The project proponent told BOEM that it will not make a business-case decision to sanction the project until the end of 2018, at which point it would determine if it needs to apply to BSEE.
The district is uncertain if it will receive the required dependencies information in time to render a decision by the original target milestone. Since modifications cannot be made in less than 30 days, we are requesting a time extension now although hope it isn't actually needed.
Agency staff tried to change the target date on December 27, 2017 (more than 30 days before the target date); however, due to staff leave over the Holidays, this update could not be made before the lock-out. Further, FPISC-OED failed to approve of the date change before the January 26, 2018 target date was missed. FPISC-OED has already approved via e-mail for this update to occur.
