Project sponsor is aware of delay and is working with Navy to complete the NHPA Section 106 and Tribal Consultations by June 30. Date change does not affect the permitting timetable as it is not on the critical path. DoD CERPO has been informed and understands that project sponsor & the Navy have significant participatory roles in getting consultations completed.
The new target dates for the export authorization is based on changes in FERC’s published schedule for the project. The export authorization is dependent on FERC's decision.
1. Project sponsor is not concerned with the date change as per April 1st email. 2. Date does not affect any other aspects of the permitting timetable but USACE coordinated with all involved agencies and the project sponsor. 3. The Section 106 process for this process remains paused and this is a dependency for issuance of USACE authorization. This is the fourth extension request and it has not been discussed at the project-specific CERPO meeting. 4. It remains unknown at this time whether the permitting timetable can be adjusted. Completion of the Section 106 process remains a dependency.
The issuance of the export authorization is dependent on the issuance of FERC's final order.
Project was placed in paused status August 2018 pending NYC Office of Management and Budget re-evaluation of the project's preferred alternative. NYCOMB re-evaluated the project in coordination with the project sponsor, the NYC Department of Design and Construction and its partner the NYC Department of Parks and Recreation. The current project has a new preferred alternative. This decision to pause the project was done in coordination with FPSIC. Coordination with the lead agency (NRC) took place on 26 April via email. Coordination with the sponsor (FPL) took place via meeting on 23 April. All are aware of the need for a time extension and are working to provide necessary information to complete the USACE process. Although the Corps is making every attempt to render a permit decision by May 22, 2019, a decision cannot be made until a mitigation plan is provided by the applicant that meets the requirements of 33 CFR 332.

The BLM also consulted with the project sponsor in developing the updated schedule. The sponsor concurs with the schedule and are "encouraged and look forward to implementing the schedule [BLM] provided."
