Milestone Extension: Authorization and Certification

From EPA: The date of issuance of the NPDES permit will need to be revised as a result of the overall schedule changes for the EIS. To be consistent with the new EIS timeline and expected issuance date of the EIS ROD, EPA would like the NPDES issuance date changed to November 13, 2018.

Milestone Extension: Section 10 Rivers and Harbors Act of 1899 and Section 404 Clean Water Act

An outstanding item for the Department of Army's application is the 408 review which evaluates impacts to Federal projects. The applicant submitted their application for 408 review on July 17, 2018. After the 408 review is complete, the applicant will then submit the revised mitigation plan for the Corps' review. The Corps (Regulatory) cannot issue a permit until the 408 review and mitigation are finalized. USACE's original time estimation was based on when they received a complete mitigation plan from the applicant which they were submitting after the 408 review was complete.

Milestone Extension: Environmental Impact Statement (EIS)

All are aware of the changes due to federal funding lapsing. Lapse in funding required public meetings to be cancelled and the public comment period to be extended through the new public meetings. Public comment period was extended 8 weeks which puts the entire schedule back 8 weeks. We were already moving as quickly as possible and we can't continue until we have all comments received. We are working to address comments now as we can, but we anticipate new comments with the meetings which need to be addressed.

Milestone Extension: Special Use Permit (FS)

The project sponsor, Idaho Power, requested in an October 26, 2018 letter to the US Forest Service to pause the special use authorization for Boardman to Hemingway project until February 2019. The request was due to potential limitations in staffing for review and signing of the special use document during the holiday season. The point of contact for the pause is M. 1. Project sponsor concurs with date change. See separate email to FERC, FPISC-OED, project sponsor and cooperating agencies. 2. see #1 above 3. It is up to FERC as lead agency to document any changes in the project's CPP. This has not been discussed at any project-specific CERPO meeting. 4. Target date for permit issuance may be "moved to the left" depending upon the date of completion of the Section 106 consultation process. 5. My agency CERPO has been made aware of the fact that the date is being changed because of the dependency factor.
