The issuance of the ROW is dependent on the completion of the NEPA for Phase II. The was Draft EA for BLM review was delayed by the project sponsor. The EA is an applicant provide document and it was received on August 12, 2019. It is anticipated that EA-3 will be completed by the Dec 31, 2019. The pauses in the

Section 106 review consultation will conclude with the Programmatic Agreement. The PA has been drafted but has not been finalize but is in the Final EIS that published in the September 13, 2019 Federal Register. Discussions on the draft PA are ongoing and public comment is still being accepted. The date has been changed to reflect the ongoing consultation.
