Milestone Extension: Endangered Species Act Consultation (NOAA-NMFS)

  The project sponsor’s delayed submission of information needed for a complete Marine Mammal Protection Act (MMPA) Incidental Take Authorization (ITA) application has resulted in delays to the schedule for NMFS’s issuance of the proposed ITA as well as delays to the development of complete Endangered Species Act (ESA) and Essential Fish Habitat (EFH) consultation documents, the Draft Environmental Impact Statement (DEIS), the Final Environmental Impact Statement (FEIS) and all other subsequent dependent milestones.

Milestone Extension: Section 408 Permit

  The project sponsor’s delayed submission of information needed for a complete Marine Mammal Protection Act (MMPA) Incidental Take Authorization (ITA) application has resulted in delays to the schedule for NMFS’s issuance of the proposed ITA as well as delays to the development of complete Endangered Species Act (ESA) and Essential Fish Habitat (EFH) consultation documents, the Draft Environmental Impact Statement (DEIS), the Final Environmental Impact Statement (FEIS) and all other subsequent dependent milestones.

Milestone Extension: Use Authorization (DOI-BOR)

The application was deemed complete on December 7, 2023.  Due to GIS issues, there were missing facilities on the project application.  The project sponsor is in the process of correctly identifying facilities under BOR jurisdiction and anticipates submittal of the supplemental application information in March 2024.  BOR will review the supplemental application materials and deem complete no later than June 28, 2024 if received in March 2024.

Milestone Extension: Section 106 Review

Additional time is required for the Section 106 Programmatic Agreement (PA) because more interested parties have been identified than originally anticipated.  The PA process has identified more than 30 interested parties, and due to the logistical considerations of engaging with this large number of interested parties, more time is needed to fully inform them of the proposed PA and provide them with opportunities to participate.
