A shift of BOEM’s EIS action milestones by 119 days results in a commensurate shift to these ESA action milestones. Milestone Extension: Clean Water Act Section 402 Permit, National Pollutant Discharge Elimination System (EPA)
The NPDES Permit milestones are dependent on BOEM's EIS action milestones. With the shift in the ROD date, EPA will accordingly extend the milestone date for issuance of the final decision for permit/approval of the Clean Water Act Section 402 permit. This enables EPA to ensure compliance with ESA and with other laws, such as those related to Essential Fish Habitat (EFH).
