Milestone Extension: Section 404 Clean Water Act

The FAST-41 covered Santa Fe Indian School (SFIS) Pueblo Education Network (PEN) Environmental Assessment (EA) has run into issues and needs to extend the Permitting Dashboard milestones. Due to SFIS staffing changes, it has taken time to establish training of new staff and further project execution. Since early summer 2024, consultant contracts and spending were put on hold and has resulted in a number of environmental review and permitting timeline delays.

Milestone Extension: Section 408 Permit

Applicant technical information delays and application resubmittal have resulted in decision postponement for the Section 408 review and the need to shift the 29 October 2024 final decision milestone to 16 December 2024.

Because the Commission’s milestone target dates, including those for issuance of the draft and final NEPA documents and order, were modified to account for the additional time needed for the project sponsor to complete required studies, dependent milestone target dates are being modified accordingly.

Milestone Extension: Endangered Species Act Consultation (DOI-FWS)

Because the Commission’s milestone target dates, including those for issuance of the draft and final NEPA documents and order, were modified to account for the additional time needed for the project sponsor to complete required studies, dependent milestone target dates are being modified accordingly.    

Milestone Extension: Right-of-Way Authorization (DOI-BIA)

The Project Sponsor has asked for an additional five months to complete its coordination with the Pueblos and Tribes, which the Project Sponsor is engaged in as part of the Section 106 process. The Project Sponsor is continuing to work with the Pueblos and Tribes on cultural surveys and sensitivity concerns and is making small refinements to the alignment of the proposed route to avoid certain cultural resources. The Section 106 consultation and route alignment affect timing of the Environmental Assessment, which then affects the cooperating agency dependent actions.
