Section 106 review consultation will conclude with the Programmatic Agreement. The PA has been drafted but has not been finalize but is in the Final EIS that published in the September 13, 2019 Federal Register. Discussions on the draft PA are ongoing and public comment is still being accepted. The date has been changed to reflect the ongoing consultation.

Is the project sponsor concerned with the date change? The date change is necessitated by the large number of substantive issues raised during the public comment period which require additional time to mediate. The applicant is aware of the delay and has submitted a FOIA request for the comment report. Does the date change affect any other aspects of the permitting timetable? If so, did you coordinate with the affected agencies?

The lead Federal agency has indicated that delays have occurred in NHPA compliance, and identified via email on September 26, 2019, that they recommend a revised target date of January 31, 2020, for the decision.
The Nevada SHPO is requiring more documentation and reports and they get an automatic 30 day extension on every request that they send to BLM.
