The lead Federal agency has indicated that delays have occurred in NHPA compliance, and identified via email on September 26, 2019, that they recommend a revised target date of January 31, 2020, for the decision.
Milestone Extension: Section 106 Review
The Nevada SHPO is requiring more documentation and reports and they get an automatic 30 day extension on every request that they send to BLM.
Milestone Extension: Environmental Impact Statement (EIS)
The target date has now changed a week from the original date of 1/3 to 1/17 due to a partial lapse in government funding, earlier this year. Proponent is aware and tailored their submittal of applications to cooperating agencies with the 1/17 date in mind. All are aware of this change and are in support of this schedule.
Milestone Extension: Right-of-Way Authorization (DOI-BLM)
Sponsor is not concerned with the date change, no other aspects of permitting timetable are affected. Justification for delay documented under the action in the dashboard. The DOI Cerpo is aware of the delay.

Milestone Extension: Natural Gas Export Authorization
The new project date is 90 days after FERC’s new projected order date of 2/13/20. DOE's issuance of an export is dependent on the release of FERC's order.
FAST-41 Missed Date: Endangered Species Act Consultation (DOI-FWS)
Final Required Milestone Date of 05/10/2021 for Conclusion of ESA Consultation has passed by 5 business days
Milestone Extension: Section 106 Review
Execution of the 106 Programmatic Agreement was delayed pending proposed changes requested by one of the consulting parties. The project sponsor changed the date accordingly for the conclusion of the 106 PA and the Record of Decision which will not be issued on December 6, 2019. Issues were not included in the most recent quarterly CPP. The CERPO has been made aware. These delays will not have any significant impact on the project.
Milestone Extension: Marine Mammal Protection Act (MMPA) Incidental Take Authorization – DOC - NOAA/NMFS
While the current extension request from 12/1/19 to 12/31/19 for publication of the final rule is greater than 30 days from the ORIGINAL date, it is less than 30 days from the currently published target date for this milestone. As a reminder, the schedule was adjusted in fall 2018 to better align with the applicant's (Hillcorp) revised permitting and construction timeline for the project, which extended the construction schedule by at least one year.
