Milestone Extension: Section 106 Review

The implementation of the above-mentioned policies is essential to ensure that development of the EIS is consistent with current legal and policy frameworks, and requires additional time for intra-agency coordination, stakeholder engagement, and technical analysis. These contributing factors have resulted in a 180-day delay to the development of the EIS. Therefore, the NEPA milestone dates have shifted 180-days as detailed in the table below.

Milestone Extension: Environmental Impact Statement (EIS)

Milestone Extension: Right-of-Way Authorization (DOI-BIA)

BIA coordinated with the project sponsor (Santa Fe Indian School) and the lead agency (NTIA) to adjust the milestone deadlines. We propose bumping Zuni Agency ROW (where construction is intended to begin first) out 6 months and bumping Ramah Agency and Southern Pueblos Agency ROWs out 9 months. This will provide sufficient time for SFIS to submit complete ROW applications and for legal review of recently submitted waivers for definite location. For further justification, please see the attached.

Milestone Extension: Outer Continental Shelf (OCS) Air Permit

BOEM conducted a comprehensive status of the development of the EIS and found that publication of the Draft EIS on September 19, 2025, is no longer feasible. BOEM estimated that publication of the Draft EIS would be delayed by approximately 10 months (308 day shift) to July 24, 2026. Therefore, subsequently adjusted the remaining milestones for actions accordingly.
