A confluence of interconnected issues has contributed to the need to revise the overall permitting timetable for this project. BOEM NEPA schedule was extended 119 days, so NMFS milestones adjusted accordingly.
The Project schedule provided by the proponent accounted for a delivery of a final Plan of Development to the BLM on 4 April 2025 which needed to include a NV
The ESA milestones "FWS Determines ESA Consultation Package is Complete - Formal" and "ESA Consultation Concludes" are dependent on BOEM’s EIS action milestones. A shift of BOEM’s EIS action milestones by 119 days results in a commensurate shift to these ESA action milestones. Therefore, an extension is requested based upon the extension of BOEM’s EIS milestones. The
The NPDES Permit milestones are dependent on BOEM's EIS action milestones. With the shift in the ROD date, EPA will accordingly extend the milestone date for issuance of the final decision for permit/approval of the Clean Water Act Section 402 permit. This enables EPA to ensure compliance with ESA and with other laws, such as those related to Essential Fish Habitat (EFH).
The OCS Air Permit milestones are dependent on BOEM's EIS action milestones. With the shift in the ROD date, EPA will accordingly extend the milestone date for issuance of final decision/permit approval of the OCS Air permit.
The Section 10/404 milestones are dependent on BOEM’s EIS action milestones. A shift of BOEM’s EIS action milestones by 119 days results in a commensurate shift to the Section 10/404 action milestones. Therefore, an extension of the Section 10/404 milestones is requested based upon the extension of BOEM’s EIS milestones.
