BOEM prepared a draft EIS based on the COP updates available in November 2022 and completed a cooperating agency review of the partial DEIS in June 2023. The Project Sponsor submitted a COP update in Nov 2022 and an additional COP update in July 2023.

On 6/27/23 BOEM provided a revised EIS schedule to all cooperating agencies, which extended the EIS schedule approximately one month. The MMPA final regulations cannot be published in the Federal Register until after the ROD, the MMPA schedule is being revised to be in alignment with the new EIS/ROD schedule consistent with the Offshore Wind nominal timeline.

General Counsel informed NMFS that an additional week is needed for their review and clearance of the final ITA regulations for publication in the Federal Register. The final two milestones have been extended to allow this additional time for review. The applicant was informed of the extension and has no concerns with the MMPA milestone revisions.
