EPA deemed the Project Sponsor’s OCS air permit application complete on April 20, 2023. Accordingly, the requested final completion date for the OCS air permit action is April 22, 2024 (due to weekend).

On 6/27/23 BOEM provided a revised EIS schedule to all cooperating agencies, which extended the EIS schedule approximately one month. The MMPA final regulations cannot be published in the Federal Register until after the ROD, the MMPA schedule is being revised to be in alignment with the new EIS/ROD schedule consistent with the Offshore Wind nominal timeline.

General Counsel informed NMFS that an additional week is needed for their review and clearance of the final ITA regulations for publication in the Federal Register. The final two milestones have been extended to allow this additional time for review. The applicant was informed of the extension and has no concerns with the MMPA milestone revisions.
A detailed justification and information on consultation with the affected cooperating agencies and project sponsor are included in Commission staff’s request for Executive Director determination submitted to FPISC-OED via email.
