The USDA Rural Utilities Service (RUS) completion date for "Issuance of Final EA," was missed because the Executive Director did not timely receive a request to revise the completion date to a new date that is 30 days past the original completion date pursuant to 43 U.S.C. 4370m-2(c)(2)(D)(i)(III). This date needed to be extended and so was the date for EA Process concluded
The Service and the Corps have agreed to a 30-day extension for the consultation to allow adequate time for the Corps to review and comment on the draft biological opinion.
Triggered missed date from extending Issuance of final decision for permit/approval within 30 days of its current target date which was 10/31/2021 and extended to 01/18/2022
Due to issues regarding the sufficiency of the recently-issued FWS "Right-of-way authorization" for the project ( which may not be re-issued due to potential route changes ), the RUS currently is reevaluating the scope and alternatives for the ongoing "Final EA" analysis pursuant to the National Environmental Policy Act (NEPA). Once this reevaluation is complete, the RUS will establish an alternate completion date for the action on the Dashboard. The agency has set an alternate completion date of 11/15/2021.
Corrected date to reflect previously completed milestone
The first public notice period of the draft OCS air permit ran from 6/24/2021 through 8/9/2021. EPA is planning a second notice period in October 2021 to solicit public feedback on a change in the draft OCS air permit requirements.
On 8/19/2021, the completion date for the NOAA "Conclusion of ESA Consultation" action was changed to 10/1/2021 by agreement of the agencies. A detailed explanation for the missed 8/6/2021 completion date will be posted to the Dashboard when provided by the agencies.
