Milestone Extension: Marine Mammal Protection Act (MMPA) Incidental Take Authorization – DOI USFWS

The final Cook Inlet ITR, that includes incidental take of northern sea otters during activities associated with the Alaska LNG Project, was published in the Federal Register on August 1, 2019 (84 FR 37716). FWS has not yet received a request from the Alaska LNG Project for a Letter of Authorization under that ITR. FWS is not able to issue an LOA until it receives a request. Based on the project description and proposed timeline, FWS does not anticipate receiving a request from the Alaska LNG Project until some time in 2020.

Milestone Extension: Endangered Species Act Consultation (DOI-FWS)

FWS received a complete and sufficient Biological Assessment on November 3, 2018 and anticipated concluding consultation within the 135 days provided by statute; however, due to a lapse in appropriations the government was shut down for 35 days. FWS anticipates concluding consultation by April 22, 2019, which allows for the entire 135 days provided by statute. Project sponsor is aware of the change. This should not affect any other timetables and all agencies are aware.

Milestone Extension: Section 106 Review

1) Project sponsor (DCR Transmission, LLC) is not concerned with the delay because conclusion of the 106 process is not a critical path for project completion. Even with delay to 11/1/19 of 106 completion, record of decision on 11/22/19 will be maintained. 2) This change does not affect other aspects of permitting timetable, as stated above, record of decision date of 11/22/19 does not change. 3) Change was discussed with CERPO/Deputy CERPO on August status call and followed up on. 4) No time expected to be lost because this interim delay is not on the critical path for the project.

Milestone Extension: Special Use Permit (FS)

The applicant accepted terms of Forest Service special use permit (SUP) on December 14, 2017. SUP terms required completion of certain actions before construction activity can begin on National Forest System lands including: execution of NHPA programmatic agreement, State approval of erosion & sediment control plans and stormwater management plans, a determination by USFWS regarding impacts to candy darter, and finalize timber sale contract.

Milestone Extension: Section 404 Clean Water Act

The project sponsor has paused this permit review. As such we are marking the permit as Paused, and changing the target date. Amber Levofsky confirmed via e-mail dated 6/27/17 that this permit/milestone should be paused.
