The only remaining Federal action for this project is BSEE "authorization and certification," which cannot occur until the project sponsor submits, and
11/30/2021: RUS in coordination with the project sponsor has identified new alternative completion dates for the "Issuance of Draft EA / Release for Public Review 2," "Issuance of a Final EA," and "EA Process Concluded" actions for this project. The "Issuance of Draft EA / Release for Public Review 2" date is changing from 10/29/2021 to 12/17/2021 and the "Issuance of a Final EA" and "EA Process Concluded" action dates are changing from 11/26/2021 to 01/28/2022.
Due to issues regarding on-going litigation and the revocation of the FWS "Right-of-way authorization", the RUS is re-issuing a draft EA for public comment pursuant to the National Environmental Policy Act (NEPA). The agency currently estimates an alternative completion date for the "Issuance of a Final EA" action of November 26th.
Date identified was not correct. The ROD is anticipated for 8/17/2023 so the date for this milestone should reflect up to 3 months following ROD.
NOAA intends to adopt BOEM's FEIS and co-sign the ROD to fulfill its NEPA obligations. Therefore, the MMPA IHA decision rendered milestone must be scheduled after the ROD issuance date. This dependency is noted on the Permitting Dashboard.
Consultations under Section 106 of the National Historic Preservation Act are ongoing. Consulting parties requested additional time to review the Section 106 Memorandum of Agreement (MOA). The Record of Decision cannot be issued until the completion of the Section 106 process (i.e., execution of the MOA).
