Milestone Extension: Section 408 Permit
The applicant had initially requested a review schedule for their Kitty Hawk South project with an early NOI coming in October 2022 with the DEIS NOA occurring much later in 2024 - this timeframe has been extended, with an NOA date in Feb 2026 and a ROD date in Dec 2026. USACE milestones were adjusted accordingly.

Based upon the 29 July 2022 initiation of formal consultation, the Biological Opinion (BO) was anticipated by 12 December 2022. On 12 December 2022 the USFWS and the FERC agreed to extend the formal consultation period by 60 days to allow for additional time to coordinate and review information important to the supplemental Biological Assessment.
Milestone Extension: Endangered Species Act Consultation (DOI-FWS)
On October 4, 2022, the FWS sent FERC a letter requesting additional information on Mountain Valley Pipeline, LLC’s (MVP) Updated Supplement to the Biological Assessment (SBA2). On October 19, 2022, FERC provided FERC’s and the Service’s comments on the SBA2 to MVP.
