The Target Completion date is being changed as per overall changes in BOEM's schedule. The Corps' milestone is dependent on the BOEM ROD date, which also changed.
New Project information was submitted by the project sponsor on October 4, 2022, October 14, 2022, and October 27, 2022 in response to stakeholder concerns which included an updated COP and permit applications showing a shift to the location of the BL England substation to an adjacent portion of the same property which formerly housed elements of the BL England Generating Station and adjustment of the row A wind turbine generators (WTGs) as outlined in a joint letter signed

Based upon the 29 July 2022 initiation of formal consultation, the Biological Opinion (BO) was anticipated by 12 December 2022. On 12 December 2022 the USFWS and the FERC agreed to extend the formal consultation period by 60 days to allow for additional time to coordinate and review information important to the supplemental Biological Assessment.
On October 4, 2022, the FWS sent FERC a letter requesting additional information on Mountain Valley Pipeline, LLC’s (MVP) Updated Supplement to the Biological Assessment (SBA2). On October 19, 2022, FERC provided FERC’s and the Service’s comments on the SBA2 to MVP.

This milestone is dependent on the EIS ROD milestone in the EIS milestones. The ROD milestone moved due to the DEIS delay. This milestone needs to be 120 days after ROD. The DEIS delay is due to lessee not providing a complete and sufficient Historic Resources Visual Effects Assessment (HRVEA) and Terrestrial Archaeological Resources Assessment (TARA) and Visual Impact Assessment (VIA). Without this data BOEM cannot identify historic properties and assess the effects of the project or conduct necessary Section 106 consultation prior to publication of the draft EIS.
To issue this authorization USACE needs the BOEM ROD. The ROD Milestone was moved due to the delay of the DEIS.
