The project sponsor submitted an updated COP to BOEM on September 29, 2025. On October 1, 2025, the government shut down through November 12, 2025, impacting BOEM’s ability to review the COP submission. In addition, multiple agency comments were not addressed by the project sponsor in their September 29, 2025 COP submission and the project sponsor indicated that the Underwater Acoustic Assessment, Historic Resources Visual Effects Assessment, and Seascape and Landscape Visual Impact Assessment and associated COP updates would be submitted later in time. BOEM expects a third and fourth COP submission prior to BOEM’s issuance of an NOI. Therefore, BOEM is shifting the completion of the Agency Review of Updated Application for Consistency with NOI Checklist milestone from November 28, 2025 to February 2, 2026 and completion of the Applicant Submits Updated Application for Consistency with the NOI Checklist from December 5, 2025 to May 28, 2027.
BOEM consulted with the project sponsor to create the new target completion date and coordinated this decision with the DOI CERPO all cooperating and participating agencies.
Milestones:
For this project, the Applicant will provide an updated COP by April 30 and BOEM will mark this milestone complete after a 30-day review period.
Additional Milestones:
Applicant provides an updated COP to complete their initial COP submission.
The COP Action includes added milestones for quarterly convening meetings during which the project sponsor will update BOEM regarding the status of COP submittals (e.g., supplemental filings, updated versions of the COP to address BOEM comments). This will be an applicant action. The milestone will be satisfied by the project sponsor arranging the convening meeting and providing a status update on submittals. The meetings will be scheduled for no later than the end of each quarter of the calendar year 2025.
Convening meetings are intended to ensure the anticipated sponsor submittals are on track to meet the requirements of 30 CFR § 585.626(b), 30 CFR § 585.627(a) and the NOI checklist. The project sponsor has elected to commit to a compressed timeframe to provide updated applications to BOEM, in order for BOEM to initiate an environmental review that aligns with the project sponsor's target timeline to provide power, under their offtake agreement.
The convening meeting updates will enable BOEM, as the lead agency, to evaluate the continued viability of the permitting timetable and make adjustments, if necessary, and in accordance with consultation requirements under FAST-41. BOEM and the project sponsor, through adaptive management practices, will determine the need to adjust the frequency of convening meetings and/or enlarge the meeting to include agencies with other actions on the Dashboard.

The milestone documents completion of BOEM's review to determine whether the COP is sufficiently complete for the purposes of issuing an NOI in accordance with the NEPA regulations at 40 CFR 1501.9 and BOEM's regulations at 30 CFR part 585. BOEM reviews the COP for consistency with published guidance titled BOEM Guidance on Information Needed for Issuance of a Notice of Intent (NOI) Under the National Environmental Policy Act (NEPA) for a Construction and Operations Plan ("NOI Checklist"). Upon completion of the review, BOEM marks this milestone complete and notifies the applicant if the COP lacks any of the required information.

Applicant submits an updated COP to comply with the NOI Checklist requirements.
BOEM conducts a review to evaluate whether the updated COP is consistent with the NOI Checklist. If the review results in a finding of consistency, BOEM marks this milestone complete, as well as the next milestone, ‘Applicant submits an Application Consistent with the NOI Checklist’.
However, if the review results in a determination the application isn’t consistent with the NOI Checklist, BOEM will mark this milestone complete and communicate the insufficiency to the Project Sponsor. And, at BOEM’s discretion and dependent on the extent of insufficiency, either:
- the Project Sponsor agrees to submission date(s) for any outstanding information needed to address the insufficiency by the next milestone. BOEM may elect to activate added milestone(s) to ensure the Project Sponsor is on track to correct the insufficiency by the next milestone,
or,
- BOEM will require the Project Sponsor submit another updated COP for a third round of review. The minimum baseline for a third round of review will be based on an assumption of 60 days for the Project Sponsor to submit the updated COP and 60 days for BOEM to review the updated COP, for a total of 120-days. BOEM would activate additional milestones for the third round of review and also extend the entire Permitting Timetable by 120 days.
