  • Non-conformance Explanation:
    On July 12, 2025, the project sponsor directed the BLM to cease all processing activities, while indicating that they did not wish to pause the FAST-41 process. At that time, BLM notified the sponsor that the project’s funding had lapsed due to the sponsor’s lack of response to BLM’s prior request for additional funds. In accordance with 43 CFR 2804.19(d) and the terms of the project’s Cost Recovery Agreement, BLM cannot resume work on the application until sufficient funds are received. Although the sponsor indicated their intent to provide additional funding, the required funds to re-initiate work were not received until October 1, 2025. By that time, the BLM was initiating Government shutdown protocols, and the deadline for submitting a request to update FAST-41 milestones had already passed. BLM policy, as outlined in the H-1301-1 Fund Code Handbook, requires managers to ensure that employees do not continue work in sub-activities where funding is depleted or unavailable. Additionally, per the H-1372-1 Cost Recovery Handbook, funds must be deposited into cost recovery accounts before obligations are incurred. These policies are in place to ensure compliance with the Antideficiency Act, which prohibits federal agencies from incurring obligations in excess of available appropriations. Because the project funds were depleted and no additional funding sources were available at the time, BLM could not continue work necessary to meet milestones or submit a request to update the project schedule.

Description:

Bennett Solar B LLC proposes to construct, operate, maintain, and decommission a 240-megawatt (MW) solar photovoltaic (PV) power generating facility with a 960-MW hour (MWh) battery energy storage system.  The Project area is located approximately 6 miles east of Mountain Home, Idaho, and would be sited on approximately 2,122 acres of public land administered by the U.S. Bureau of Land Management (BLM).  The Project would also include a 230-kilovolt generation interconnection (gen-tie) line, PV module arrays, monitoring and maintenance facilities, electrical collector lines, and access roads.
