Milestone Extension: Section 10 Rivers and Harbors Act of 1899 and Section 404 Clean Water Act

Based upon the 29 July 2022 initiation of formal consultation, the Biological Opinion (BO) was anticipated by 12 December 2022.  On 12 December 2022 the USFWS and the FERC agreed to extend the formal consultation period by 60 days to allow for additional time to coordinate and review information important to the supplemental Biological Assessment. Furthermore, on 6 December 2022, the applicant provided revised information related to Clean Water Act Section 404 discharges.  On 12 December 2022, the Corps responded with the issuance of a supplemental public notice (available by clicking on the link below).

The Corps has projected the need for a minimum of 60 days to review the final BO, incorporate and address any required project changes and/or required threatened and endangered species mitigation measures into its supporting analysis within its individual permit record of decision, and to render a final permit decision consistent with the analysis and requirements of the final BO.  The 60-day timeframe is also the minimum necessary to evaluate the need for further milestone extension requests should the contents of the final BO trigger additional unforeseen analysis and timeframes.  Therefore, as a cooperating agency, the Corps has requested a 60 day extension of the Final Decision Milestone target date from 17 February 2023 to 18 April 2023.  FERC has consulted with the Corps and the project sponsor regarding this milestone extension.

Section 10 Rivers and Harbors Act/Section 404 Clean Water Act:  The Secretary of the Army, acting through the U.S. Army Corps of Engineers (Corps), has authority to permit the discharge of dredged or fill material in waters of the U.S. under Section 404 of the Clean Water Act (CWA). The Corps also has authority to permit work and the placement of structures in navigable waters of the U.S. under Sections 9 and 10 of the Rivers and Harbors Act of 1899 (RHA) (see 33 CFR 320.2).

Therefore, USACE could not modify the permitting timetable to reflect the extended completion date. Because USACE was unable to meet the posted completion date, pursuant to 42 USC § 4370m-2(c)(2)(F), USACE appropriately established an alternative completion date for the Section 10/404 action and will adhere to the statutory procedures required by section 4370m-2(c)(2)(F) until the agency takes final action on the Section 10/404 permit.

Description:

On August 18, 2022, Mountain Valley Pipeline, LLC submitted a FAST-41 Initiation Notice for the outstanding federal environmental reviews and authorizations for the project following associated court decisions. A determination of FAST-41 coverage was made on September 1, 2022. 

The project was previously in the initial inventory of FAST-41 covered projects designated by the Executive Director of the Federal Permitting Improvement Steering Council in September 2016 before being closed out on the Permitting Dashboard in late 2017.  

As described in the project sponsor’s FAST-41 Initiation Notice, the project includes the construction of approximately 304 miles of natural gas pipeline in West Virginia and Virginia, three new compressor stations in West Virginia, metering stations, taps, and appurtenant facilities. The project would provide up to 2,000,000 dekatherms per day of firm natural gas transportation service from northern West Virginia to southwestern Virginia.

Therefore, the action is no longer subject to ED review, but instead, the action will be in nonconformance. USACE confirmed on 2/21/23 that they did not meet their 2/17/23 final milestone. The ED review that currently shows on the backside of the dashboard needs to be rejected to allow the dashboard to trigger the nonconformance. Within 5-days of the enabling the nonconformance, the final USACE milestone will be updated with the appropriate nonconformance explanation and alternative completion date.
