Milestone Extension: Section 10 Rivers and Harbors Act of 1899 and Section 404 Clean Water Act

The Section 10/404 milestones are dependent on BOEM’s EIS action milestones. A shift of BOEM’s EIS action milestones by 119 days results in a commensurate shift to the Section 10/404 action milestones.  Therefore, an extension of the Section 10/404 milestones is requested based upon the extension of BOEM’s EIS milestones.

Description:

Department of Army authorization from the US Army Corps of Engineers Norfolk District is required pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act.  Activities that require authorization include: Offshore, the installation/construction of up to 205 wind turbine generators (WTGs) and three Offshore Substations. The trenching and placement of the Inter-Array Cables, and Export Cables to the proposed landing locations. Temporary ports and laydown areas will also be required. The onshore components of the project will consist of the construction of up to two Cable Landing Locations, Horizontal Directional Drilling of the Cable Landing Location(s) to a Collector Station at Naval Air Station Oceana, Interconnection Cables above or below ground from the Collector Station to the existing Onshore Fentress Substation. An aquatic resource delineation and jurisdictional determination will be performed to determine the impacts to Waters of the US.

Description:

Vineyard Northeast proposes to construct and operate the Project located in Lease Area OCS-A 0522, which covers approximately 132,370 acres (ac) and is located approximately 31 miles from Nantucket, Massachusetts and 39 miles from Martha’s Vineyard, Massachusetts.

Offshore components of the Project will consist of up to 160 wind turbine generators (WTG) and electrical service platform (ESP) positions within the Lease Area with one nautical mile spacing between positions. The WTGs and ESPs will be supported by monopiles or piled jacket foundations.

Between the Lease Area and shore, the offshore export cables will be installed within two offshore export cable corridors (OECC), the Massachusetts OECC and the Connecticut OECC.

    • The Massachusetts OECC will travel from the northernmost tip of the Lease Area to the Horseneck Beach Landfall site in Westport, Massachusetts.
    • The Connecticut OECC will travel from the southernmost tip of the Lease Area to three potential landfall sites: Eastern Point Beach, Ocean Beach, and Niantic Beach; all near New London, Connecticut.

Onshore components of the Project will include export cable landfall areas, high-voltage direct current onshore cables, high-voltage alternating current interconnection cables, converter and booster stations, and onshore substation facilities in Massachusetts and Connecticut.
