Description:
Section 305(b)(2) of the Magnuson-Stevens Fishery Conservation and Management Act (MSA) requires federal agencies to consult with NOAA Fisheries on any action or proposed action that may adversely affect Essential Fish Habitat (EFH). The proposed action may adversely affect these resources; therefore, EFH consultation is required. The final consultation completion date is contingent upon NOAA Fisheries receiving sufficient information to initiate EFH consultation.

This reflects the anticipated date of receipt of the initial EFH Assessment from the USACE. EFH consultation request expected to be concurrent with the lead agency’s issuance of the Draft EIS. Meeting this milestone target date is contingent upon NOAA Fisheries receiving an EFH Assessment from the lead agency by the date provided.

Description:
The purpose of the proposed project is to construct a channel with the capability to accommodate the transit of fully laden Very Large Crude Carriers (VLCCs) from multiple locations on Harbor Island, TX and into the Gulf of Mexico. The Department of the Army permit application submitted by the project sponsor to USACE, the FAST-41 Initiation Notice, public notices, and other significant supporting documents for the environmental review process can be found on the USACE Galveston District website here.

The Executive Director granted a U.S. Army Corps of Engineers request to extend the Section 106 Review completion date on June 14, 2022. The Executive Director determination is posted here.
