  • Non-conformance Explanation:
    Initial submissions of a Cultural Resource Report by Reagan Smith and their subcontractor  did not meet the Secretary of the Interior’s Standards for Archaeology and Historic Preservation nor the Council of Texas Archaeologists Standards and Guidelines. Due to delays in delivery of a Cultural Resources Report that met applicable standards, the National Forests and Grasslands in Texas Heritage staff was unable to verify contents of the January 20 version of the Cultural Resources Report before initiating Section 106 Consultation on January 23, 2026. In order to meet the January 23 dashboard milestone for initiation of Section 106 consultation, the Cultural Resources Report was provided for concurrent review by the National Forests and Grasslands in Texas, the Texas Historical Commission/State Historic Preservation Office, and Tribal Historic Preservation Officers. Due to weather delays, return receipt for delivery of hard copies was dated February 2, 2026, so the 30-day review period afforded by regulations at 36 CFR 800.3(c) concluded on March 4, 2026. On March 4, comments were received from the Alabama-Coushatta Tribe of Texas, requesting revisions to the Cultural Resources Report. Comments requesting revisions were also received from the Texas Historical Commission/State Historic Preservation Office. The National Forests and Grasslands in Texas also provided comments requesting revisions. An adequately revised Cultural Resources Report was received from Reagan Smith and their subcontractor on March 26, 2026, and sent to Texas Historical Commission/State Historic Preservation Office and Tribal Historic Preservation Officers on March 27, 2026, with a request for concurrence on an expedited timeline. The Alabama-Coushatta Tribe of Texas and the Caddo Nation have responded that they will require the full 30-day review period afforded by regulations at 36 CFR 800.4(d)(1). The return receipt for delivery of a hard copy of the revised Cultural Resources Report to the Coushatta Tribe of Louisiana is dated April 1, 2026. This marks the start of their 30-day review period afforded by regulations. For these reasons, the current target date of April 10, 2026, for conclusion of Section 106 consultation has not been met. USDA proposes an alternate completion date of May 1, 2026 – 30 days after the date of the return receipt for delivery of a hard copy of the revised Cultural Resources Report to the Coushatta Tribe of Louisiana.This decision has been coordinated with Tribal Historic Preservation Offices and the Texas Historical Commission. The project sponsor was consulted in creating the alternate completion date. The Section 106 Consultation Concluded Milestone – Alternate Completion Date could potentially affect the Categorical Exclusion Final Decision milestone date, which is also set for May 1, 2026. No other cooperating agencies are affected by the Categorical Exclusion Final Decision milestone date. The agency CERPO is aware of this alternate completion date.

Description:

Silver Hill Energy is proposing to build a natural gas trunk pipeline through the Sabine National Forest along with four drilling well pads to develop their existing Federal mineral leases.  The project area is located in Shelby County, TX, directly east of the town of Goober Hill, TX.
