Agency Milestone Date of 05/05/2023 for FWS determines ESA Consultation Package is Complete - Formal (Agency Action) has passed by 1 business days The lead action agency, BOEM, requested to change these milestone dates, because BOEM anticipates submitting a revised BA and response to agency comments on April 17, 2023. This submission date may not provide the USFWS sufficient time to review and deem the consultation package is complete by the previous ESA consultation conclusion date which was May 5, 2023. BOEM and USFWS had a call on March 28, 2023 to discuss and both agencies agreed to a new schedule. Subsequently, on May 22, 2023, BOEM, the applicant, and the USFWS agreed to extend the second milestone from 6/13/23 to 7/19/23, and the final milestone from 10/26/23 to 12/1/23 because the USFWS needs additional time review the consultation package and provide comments to BOWM before the consultation package can be deemed complete.

Description:
The purpose of the Atlantic Shores South (which includes Project 1 and Project 2 or, collectively, the Projects) is to develop two offshore wind energy generation facilities in the Bureau of Ocean Energy Management (BOEM) Lease Area OCSA 0499 to provide clean, renewable energy to the Northeastern U.S. by the mid-to-late 2020s.
Update:
The Executive Director granted a Bureau of Ocean Energy Management request to extend the COP (BOEM), Section 106 (BOEM), Section 408 (USACE) completion dates. The Executive Director determination is posted here.
