Milestone Extension: Magnuson-Stevens Fishery Conservation and Management Act, Section 305 Essential Fish Habitat (EFH) Consulta

The United States Army Corps of Engineers (USACE), on behalf of the Coastal Protection and Restoration Authority, (Applicant/Project Sponsor), is requesting time extensions for all the planned and in-progress target milestone dates on the permitting dashboard for the Applicant’s Mid-Breton Sediment Diversion project.  This revised schedule is due to the Applicant’s change in the design of the Applicant’s preferred alternative (APA) from 75,000 cubic feet per second (cfs) to 50,000 cfs in November 2021.

BOEM agreed to provide additional time (2 additional weeks) between EFH consultation initiation (Milestone #2) and providing our EFH conservation recommendations.  The delays in the EFH schedules for multiple projects are resulting in initiation dates and CR due dates aligning at the same time.  As such, BOEM was amenable to provide us an additional 2 weeks to provide our EFH conservation recommendations, since this would still provide them with sufficient time to get the consultation incorporated into the FEIS.

The applicant had initially requested a review schedule for their Kitty Hawk South project with an early NOI coming in October 2022 with the DEIS NOA occurring much later in 2024 - this timeframe has been extended, with an NOA date in Feb 2026 and a ROD date in Jan 2027.  USACE milestones were adjusted accordingly.
