USACE Norfolk District
The Norfolk and Wilmington Districts of the U.S. Army Corps of Engineers are processing applications for Department of the Army permits pursuant to Section 404 of the Clean Water Act to authorize discharges of dredged and/or fill material into jurisdictional waters of the United States in conjunction with construction of the proposed pipeline. At this time it appears that the project is eligible for authorization under Department of the Army Nationwide Permit #12, but the district will make such determination upon receipt of a complete permit application.

Based upon information provided by the project sponsor, the Norfolk District of the U.S. Army Corps of Engineers is changing the target date for receipt of a complete permit application from the project sponsor from May 31, 2021 to 31 August 2021. The Corps target date for the receipt of a complete application is dependent on the receipt of a complete application from the project sponsor by the target date, and the date is subject to change based on the project sponsor's schedule for submitting the necessary information.
Based upon information from the project sponsor, the target date for receipt of application is changed from January 31, 2022 to May 31, 2022. Based upon information provided by the project sponsor, the Norfolk District and Wilmington District of the U.S. Army Corps of Engineers are changing the target date for receipt of a complete permit application from the project sponsor from May 31, 2021 to August 31, 2021. Also, the target date for permit decisions is being correspondingly changed from July 30, 2021, to September 30, 2021, approximately 60 days from the target date for receipt of a complete permit application. The permit decision date may be dependent upon multiple factors, including but not limited to, the receipt of complete permit applications by August 31, 2021 from the project sponsor; the completion of the Environmental Impact Statement and Record of Decision; consultations pursuant to the Endangered Species Act and the National Historic Preservation Act; and issuance or waivers of Water Quality Certifications pursuant to Section 401 of the Clean Water Act by the Commonwealth of Virginia and the State of North Carolina. The Corps target date for the final permit decision/verification will be altered accordingly if the schedules for these dependent actions change, and/or if the project sponsor's schedule for submitting the necessary information changes.
Based on information provided by the project sponsor, the target permit decision dates is changed to August 1, 2022. This date is approximately 60 days from the target date for receipt of a complete permit application.
