The Section 408 milestones are dependent on BOEM’s EIS action milestones. A shift of BOEM’s EIS action milestones by 417 days results in a commensurate shift to the Section 408 action milestones.
In addition to the shift to the schedule to address the EIS, USACE is also requesting to move the Section 408 Complete application submitted (Applicant Action) Milestone. The USACE now calculates this date as 60 days before the ROD is issued by BOEM. USACE has refined this milestone definition based on lessons learned from earlier applicants. Therefore, an extension of the Section 408 milestones is requested based upon the extension of BOEM’s COP and EIS milestones

A Section 408 Permission is required from the US Army Corps of Engineers pursuant to Section 14 of the Rivers and Harbors Act of 1899, 33 U.S.C. 408 (Section 408) and the Corps will evaluate the proposed activity relative to the nearby US Army Corps of Engineers Civil Works Projects and assets.

Description:
Skipjack Offshore Energy, LLC (SJOE) intends to develop, build, operate, and own (through one or more affiliated special purpose entities) an offshore wind farm located approximately 15 miles off the coast of Delaware within Lease Areas OCS A0519 and OCS A0482. The purpose of the Project is to construct and operate a new offshore wind farm designed to help one or more states within the mid-Atlantic region meet their clean energy goals. The Project would consist of up to 72 wind turbine generators (“WTG”), associated inter-array cabling, new onshore and offshore substations, transmission cables and onshore works for connection to the wholesale electric grid administered by PJM Interconnection L.L.C.
