Description:

The Commission's issuance of a decision on a license application under the Federal Power Act is dependent on the issuance of a final National Environmental Policy Act document, the resolution of consultation under section 7 of the Endangered Species Act and section 106 of the National Historic Preservation Act, and the issuance of a water quality certificate under section 401 of the Clean Water Act.  The milestone target dates below are dependent on the project sponsor resolving all application deficiencies, additional information needs, and required studies by October 31, 2024.

Description:

The proposed 972-megawatt project would use the Bureau of Reclamation's existing Seminoe Reservoir on the North Platte River in Carbon County, Wyoming, as a lower reservoir and include the construction of a new upper reservoir; two 30-mile-long, 500-kilovolt transmission lines; and other project facilities.  The proposed project facilities would be located on Bureau of Land Management and Bureau of Reclamation lands.

FERC milestone is being updated to reflect the latest Commission order. Pursuant to the FAST-41 savings and limitations clauses at 42 U.S.C. §§ 4370m-6(d)(1) and 4370m-6(e)(2), respectively, in light of FERC’s regulations preventing disclosure of the nature and timing of proposed actions by the Commission (18 C.F.R. § 3c.2(b)), FERC may modify its own completion dates on a FAST-41 permitting timetable.
