Geothermal Lease

A geothermal lease confers te right to explore for, drill, produce and utilize geothermal resources on federal lands with limitations. Subsequent permits required prior to any surface disturbing activities. Geothermal leases have a primary term of ten years. A lessee that has not developed a well capable of producing geothermal resources in commercial quantities by the end of the ten- year primary term can apply for an initial five-year extension and an additional five-year extension by meeting diligent exploration expenditure requirements.

The Marine Mammal Protection Act (MMPA) prohibits the take of marine mammals. Federal agencies and individuals must seek authorization to incidentally take marine mammals when conducting otherwise lawful activities. Two types of incidental take permits can be issued: Incidental Harassment Authorizations (IHAs) and Letters of Authorization (LOAs).  IHAs authorize, for periods of not more than one year, incidental taking by harassment only (i.e., injury and/or disturbance but not serious injury or mortality).

The Marine Mammal Protection Act (MMPA) prohibits "take" of marine mammals with certain exceptions.  The MMPA allows, upon request, the incidental take of small numbers of marine mammals by U.S. citizens who engage in a specified activity (other than commercial fishing) within a specified geographic region provided the taking would be of small numbers; have no more than a negligible impact on those marine mammal stocks or species; and the take would not have an unmitigable adverse impact on the availability of the species or stock for subsistence uses.
