Description:

DOE has jurisdiction under the Natural Gas Act, Sections 3(a) and 3(c), for the permitting of natural gas exports from the United States. The application under Section 3(a) is before DOE and tied to the NEPA review at FERC.

90 days following FERC's issuance of Final NEPA document including binding environmental conditions. FERC’s binding environmental conditions are set out in its final order. 

The final completion date is calculated according to 18 C.F.R. § 157.22 (2016), which provides that "a final decision on a request for a Federal authorization is due no later than 90 days after the Commission issues its final environmental document, unless a schedule is otherwise established by Federal law."  

The issuance of decision for permit/approval date includes a Record of Decision and a Final Opinion and Order for long-term exports of LNG.
