Description:

Section 7(a)(2) of the Endangered Species Act (ESA) requires federal agencies to consult with NOAA Fisheries when any project or action they take may affect an ESA-listed species under NOAA Fisheries’ jurisdiction, or critical habitat for such species.  The subject proposed action involves the U.S. Army Corps of Engineers’ (Corps) permitting of Plains Pipeline, L.P.’s (applicant) proposed oil pipeline replacement project at a crossing on Refugio Creek, in Santa Barbara County, California.  This action is of concern because Refugio Creek is within range of the endangered Southern California (SC) distinct population segment of steelhead (Oncorhyncus mykiss) and is designated as critical habitat for this species.  The proposed action has the potential to affect these resources, therefore Section 7 consultation is required.
