Description:
The New York State Department of Transportation, in cooperation with the FHWA, will prepare an EIS in accordance with the National Environmental Policy Act for the New York State (NYS) Route 5 (Buffalo Skyway) Project, located in Erie County, New York. The Buffalo Skyway/NYS Route 5 interchanges, approaches and infrastructure, extending 3.5 miles from Tifft Street to Church Street, occupy approximately 45 acres of land along the Buffalo waterfront. Over the past few decades, this area has undergone a substantial change in land use with a focus on recreational, mixed-use, and waterfront development. The purpose of the Project is to realign the existing transportation network to support existing and planned recreational, mixed-use, and waterfront development in the Buffalo Outer Harbor and Inner Harbor areas. The Project will also address the safety, operational, and capacity deficiencies of the highway connections that serve economic development areas and local communities within South Buffalo.

This milestone is dependent on the applicant's submittal of a complete preconstruction notification by the target date for milestone 2, as well as the applicant's timely submittal of any information that may be necessary for a verification decision. This milestone is also dependent upon the issuance of a Section 408 permission decision by the Corps, completion of the Endangered Species Act and Section 106 National Historic Preservation Act consultations by FHWA, and completion of a 401 water quality certification or waiver from the New York State Department of Environmental Conservation.
