Although the Corps is making every attempt to render a permit decision by May 22, 2019, a decision cannot be made until a mitigation plan is provided by the applicant that meets the requirements of 33 CFR 332. The Corps is awaiting for receipt of the applicant's long-term management plan and financial assurances instrument for portions of the proposed permittee responsible mitigation areas. This information was requested on February 26, 2019, and a response was provided by the applicant on March 19, 2019, but the response did not include all of the necessary information. The Corps met with FPL on April 23, 2019 to discuss the outstanding issues with financial assurances and long-term management, both the draft instruments and the funding mechanisms. FPL will revise their mitigation plan and resubmit with the necessary changes, "as soon as possible" but were not able to provide a definitive date. As such, the Corps is requesting an extension of permitting timelines of the FPL Turkey Point project from May 22, 2019 until June 22, 2019. Should submittal of any required information be delayed, the Corps will need to continue to adjust its timeline.

The USACE proffered the remaining permit to the project sponsor (Florida Power and Light) December 18, 2019.
Florida Power and Light Company (FPL), seeks approval for constructing and operating two new AP1000 reactor units at the Turkey Point site to provide additional electricity for use in the Southern Florida service areas. The two new units would be capable of providing an additional 2200 megawatts of baseload electricity.
