Milestone Extension: Construction and Operations Plan

BOEM anticipated receipt of Marine Site Investigation Report (MSIR) hard drives and the Marine Archeology Resource Assessment (MARA) for the Lewes Route as part of the updated application anticipated to be submitted by the project sponsor on October 27, 2025. BOEM was notified on June 18, 2025, that the project sponsor would not be able to submit the updated MSIR, data hard drive, Seascape, Landscape, and Visual Impacts Assessment (SLVIA), Sediment Transport Analysis or the MARA on this date. Instead, the project sponsor has stated it will be submitted on March 27, 2026. On September 4, 2025 the project sponsor informed BOEM that there would be a further delay and the data would not be ready until August 28, 2026. Due to the large amount of data that needs to be processed and reviewed from the MARA, SLVA, Sediment Transport Analysis, and MSIR hard drives, BOEM needs 120-days to complete the Agency Review of Updated Application for Consistency with NOI Checklist, once the data is submitted. BOEM requests to add an additional round of COP milestones to the dashboard to allow for this anticipated submittal and provide BOEM time to review it. The requested milestone changes are shown in the table below.

BOEM has also been notified that the anticipated COP submission on October 27, 2025, will be a complete revision of many sections of the COP compared to the versions that have been seen. Due to this extensive update and the government shutdown, BOEM requests to shift completion of the 5th COP milestone (Agency Review of Updated Application for Consistency with NOI Checklist) from December 26, 2025, to February 6, 2026.

This milestone documents completion of BOEM's review to determine whether the COP is consistent with the NOI Checklist in accordance with the NEPA regulations at 40 CFR 1501.9 and BOEM's regulations at 30 CFR part 585.

BOEM reviews the COP for consistency with published guidance titled ‘BOEM Guidance on Information Needed for Issuance of a Notice of Intent (NOI) Under the National Environmental Policy Act (NEPA) for a Construction and Operations Plan,’ (the NOI Checklist). Upon completion of the review, BOEM marks this milestone complete and notifies the applicant if the COP lacks any of the necessary information.

BOEM conducts a review to evaluate whether the updated COP is consistent with the NOI Checklist. If the review results in a finding of consistency, BOEM marks this milestone complete, as well as the next milestone, ‘Applicant submits an Application Consistent with the NOI Checklist’.

However, if the review results in a determination the application isn’t consistent with the NOI Checklist, BOEM will mark this milestone complete and communicate the insufficiency to the Project Sponsor. And, at BOEM’s discretion and dependent on the extent of insufficiency, either:

  1. the Project Sponsor agrees to submission date(s) for any outstanding information needed to address the insufficiency by the next milestone. BOEM may elect to activate added milestone(s) to ensure the Project Sponsor is on track to correct the insufficiency by the next milestone,

or,

  1. BOEM will activate added milestones to require the Project Sponsor update and submit the COP for a third round of review. The minimum baseline for a third round of review will be based on an assumption of 60 days for the Project Sponsor to submit the updated COP and 60 days for BOEM to review the updated COP, for a total of 120-days. Accordingly, BOEM would also extend the entire Permitting Timetable by 120 days.

Description:

Skipjack Offshore Energy, LLC (SJOE) intends to develop, build, operate, and own (through one or more affiliated special purpose entities) an offshore wind farm located approximately 15 miles off the coast of Delaware within Lease Areas OCS A0519 and OCS A0482. The purpose of the Project is to construct and operate a new offshore wind farm designed to help one or more states within the mid-Atlantic region meet their clean energy goals. The Project would consist of up to 72 wind turbine generators (“WTG”), associated inter-array cabling, new onshore and offshore substations, transmission cables and onshore works for connection to the wholesale electric grid administered by PJM Interconnection L.L.C.
