Description:

The Albuquerque District has determined that a Corps 404 permit is not required and informed the applicant via letter of this determination on 28 OCT 2019.

This milestone is dependent on the applicant's submittal of a complete individual permit application (per 33 CFR 325.1(d)(10)) or preconstruction notification (per the terms of the applicable general permit) on the target date provided for milestone 1.  The Corps would make a determination of completeness within 15 days of receipt of the application.  The applicant has not yet provided a target date for the submittal of an application, so this target date will be adjusted after more information is received from the applicant.

This milestone target date is dependent on the submittal of a complete application/PCN by the applicant by the specified date for milestone 1.  Assuming an application is required, at this time we expect to render a decision within 90 days of Bureau of Reclamation's target date for the joint agency ROD.  A final decision under our Regulatory authorities is dependent upon completion of the joint agency EIS and written documentation of compliance with Section 106 of the National Historic Preservation Act and Section 7 of the Endangered Species Act from BOR.  In addition, a Department of the Army permit cannot be issued until the Corps receives (if applicable) a Section 401 Water Quality Certification or waiver from the state water quality certifying agency. This target date will be adjusted after more information is received from the applicant.
