Description:
The Project entails development of a liquid natural gas shipping terminal in Coos Bay, Oregon, and a 230-mile pipeline across private and Federal lands in southwestern Oregon. The Service completed ESA consultation in January 2020 and determined the Project would adversely affect western snowy plover, Pacific fisher, California marten, several listed plant species, northern spotted owl, and marbled murrelet. Although impacts to the latter two species would be substantial, the Service concluded the Project was not likely to jeopardize any species. FERC then selected a Project alignment that was not analyzed in the agency’s prior Biological Assessment. Consequently, on June 23, 2020, FERC requested reinitiation of consultation. After thoroughly reviewing the information FERC provided, the Service notified FERC on July 7, 2020, that reinitiation of consultation cannot begin until additional information and a BA is received. Both agencies agreed to a collaborative process to develop the new information as quickly as possible, contingent on cooperation from Pembina. On December 4, the Service received from FERC the information needed to reinitiate consultation on this project and is reviewing that information to ensure it is complete.

Monthly Status Report for April 2021:FWS developed the current consultation process in coordination with FERC, BLM and Pembina, to include time for BLM to review draft T&Cs and propose specific revisions that would address its concerns. The extension will allow time to review the draft BO by FERC, BLM, and Pembina before it is finalized. The new target will not affect overall project schedule. In addition, we understand that the applicant may pause work on the project so we will continue to closely coordinate with all parties.
