Description:

If the project sponsor provides adequate survey information for Commission staff to make a determination of effects on historic properties, and Commission staff determine that authorizing the project would have an adverse effect on historic properties, Commission staff may seek to execute a section 106 agreement document prior to the Commission’s issuance of an order.  Commission staff would coordinate with the applicable parties (including the Advisory Council on Historic Preservation, State Historic Preservation Officer, and federally recognized tribes) to develop and execute any agreement document.  However, there are no established timelines in the National Historic Preservation Act for the applicable parties to sign an agreement document to conclude the section 106 process.
