Description:
DOE has jurisdiction under the Natural Gas Act, Sections 3(a) and 3(c), for the permitting of natural gas exports from the United States. The application under Section 3(a) is before DOE and tied to the NEPA review at FERC.
Milestones:
-
Authorization for Liquefied Natural Gas Terminal Facilities, Onshore or in State Waters
:
Final decision/agency action (Agency Action)
- Completed Date: 11/17/2022
Commonwealth LNG’s application for an export authorization under Section 3(a) of the Natural Gas Act is pending before DOE. One of the dependencies of DOE’s decision is FERC’s issuance of its final NEPA document, which DOE construes to be a final order from the Commission, including binding environmental conditions. FERC’s EIS action has been returned from a “Paused” state to an "In Progress" state. Accordingly, DOE has returned its action to an "In Progress" state and revised its milestone date.
