Description:
In May 2019, TRC, on behalf of Commonwealth LNG, LLC, requested ESA section 7 consultation with the FWS. TRC served as FERC's non-federal representative for the consultation. On June 21, 2019, the Service concurred with TRC's determination that the proposed activities were not likely to adversely affected the federally listed West Indian manatee (Trichechus manatus), the loggerhead (Caretta caretta) and Kemp’s ridley (Lepidochelys kempii) sea turtles , the red knot (Calidris canutus rufa), and the piping plover (Charadrius melodus) and its designated critical habitat. FWS noted that there may be effects to the eastern black rail (Laterallus jamaicensus jamaicensus), which is proposed for listing, and provided conservation recommendations to avoid or minimize potential effects. Currently the FWS is evaluating a final rule to list the eastern black rail as federally threatened. If/when that listing occurs, the FWS will notify FERC and an ESA section 7 consultation action can be added to Dashboard, as appropriate, if NEPA has not been completed.
