BOEM moved the Alternative Completion Date from Aug 21 to Aug 28 to address an administrative need to re-secure signatures on the Sec 106 MOA again after a late change to the parties executing the document. BOEM anticipates no concerns with executing the MOA prior to the ROD.

The Historic Property Treatment Plans (HPTPs) were received from the sponsor the on Mar 27, instead of Mar 1 as anticipated, which delayed consultations with Tribal nations and the Delaware SHPO about terrestrial archaeology mitigations and HPTPs. Those consultations are underway but unlikely to be completed within the current FAST-41 schedule. Finalization of the MOA is required prior to ROD issuance. The proposed 60-day shift in milestone allows for completion of consultations within a timeline that is well prior to ROD issuance, as required.

Additional information required of, and provided by, the Project Sponsor results in a delay of slightly more than one month in the development of the DEIS, and cascading delays in the FEIS and ROD. BOEM prepared a draft EIS based on the COP updates available in November 2022 and completed a cooperating agency review of the partial DEIS in June 2023. The Project Sponsor submitted a COP update in Nov 2022 and an additional COP update in July 2023. BOEM cannot complete the DEIS until all the Project Sponsor’s complete revisions to the PDE and associated reports have been provided, reviewed, and incorporated into the analysis in the DEIS. The PDE changes in the COP update include additional dredging, updated cable routes, and refinement of O&M facility details.  This additional information is required for the DEIS, which will shift the date for the ROD.  Since the NEPA substitution process is being used to satisfy Section 106 requirements, the final Section 106 milestone is dependent upon the EIS milestones and is shifting accordingly.

NMFS has identified the need to extend MMPA, ESA, and EFH dashboard milestone dates to allow time to address inconsistencies and questions arising from US Wind’s 1/24/23 revised ITA submission. Due to the interconnected nature of the general EIS schedule with permit submissions, BOEM plans to extend EIS milestones by 30 days in order to ensure that information from the consultations remains consistent with and is used to inform the EIS analysis. This means that the ROD will also be delayed. No final milestone dates are being extended beyond 30 days from the original target date and we are not currently in a 30 day lockout period for any milestone, so ED approval is not needed at this time. These changes will result in shifts for permit milestone dates as well.
