The Corps acknowledges the December 18, 2025 decision of the U.S. District Court for the District of Massachusetts in State of New York, et al. v. Trump, et al., 1:25-cv-11221 (D. Mass.) regarding the validity of multiple agencies’ pause on permitting wind projects pursuant to section 2(a) of the January 20, 2025 Presidential Memorandum on “Temporary Withdrawal of All Areas on the Outer Continental Shelf from Offshore Wind Leasing and review of the Federal Government’s Leasing and Permitting Practices for Wind Projects.” However, before that decision was issued, the Bureau of Ocean Energy Management (BOEM) sought in separate litigation to reevaluate its decision on the SouthCoast Wind project due to a change in interpretation of 43 U.S.C. § 1337(p)(4) and an interim determination that the Environmental Impact Statement (EIS) and other documents that BOEM prepared may have “understated or obfuscated impacts that could have subsequently been improperly weighed in making the determinations” under § 1337(p)(4). BOEM Motion for Voluntary Remand, Town & County of Nantucket v. Burgum, et al., No. 1:25-cv-00906, Doc. 21 at 7 (D.D.C. Sep. 18, 2025) (citation and internal quotation marks omitted). The U.S. District Court for the District of Columbia granted the motion and remanded BOEM’s decision for further review on November 4, 2025. Nantucket, No. 1:25-cv-00906-TSC, 2025 WL 3120419 (D.D.C. Nov. 4, 2025). Given that the Corps had adopted the BOEM EIS to inform our decision making process and because the evaluation of environmental considerations may change as a result of BOEM’s review of the EIS, the Corps cannot finalize a decision until BOEM’s reconsideration of the EIS is complete. To accommodate the time necessary to coordinate with BOEM regarding BOEM’s review of the EIS, the Corps is moving the current FAST-41 milestone from January 9, 2026 to April 9, 2026.

USACE, as a cooperating agency for this project, is providing an updated alternative completion date for the final permit milestone for the subject project under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act.  The current alternative completion date on the dashboard is September 24, 2025. Pursuant to the Presidential Memorandum, Temporary Withdrawal of All Areas on the Outer Continental Shelf From Offshore Wind Leasing and Review of the Federal Government’s Leasing and Permitting Practices for Wind Projects, USACE is unable to render the final permit at this time. Therefore, to sync our alternative completion date with other agency milestones, USACE has identified an alternative completion date of January 9, 2026, and will continually reassess the schedule based on Administration directives.  The New England District coordinated this date with the project Sponsor.

The Section 10/404 final milestone date is dependent upon the completion of BOEM’s NEPA action (i.e., ROD issuance). For this Project, the USACE review will require 90 days between issuance of the ROD and issuance of USACE’s Section 10/404 decision. Therefore, an extension of the Section 10/404 final milestone date is requested based upon the extension of the ROD milestone date.
