The Coastal Protection and Restoration authority (Applicant/Project Sponsor), is requesting time extensions for all the planned and in-progress target milestone dates on the permitting dashboard for CPRA’s Mid-Breton Sediment Diversion project.  This request is the result of a minor change in the construction area for the Project. Specifically, at the request of the Chitimacha Tribe of Louisiana and the Choctaw Nation of Oklahoma, CPRA agreed to move a portion of the basin-side vessel access alignment to avoid an archaeological site of concern to the Tribes.  That relocation required CPRA to work with the underlying landowner to identify an acceptable alternative vessel access route.  This coordination and identification of an alternative vessel access route delayed progress on USACE’s permitting and environmental review for the Project.

The USACE (lead federal agency), in coordination with CPRA (Applicant/Requester), is requesting time extensions for all the planned and in-progress target milestone dates on the permitting dashboard for CPRA’s Mid-Breton Sediment Diversion project.  Additional time is required to perform an adequate assessment of conformance with relevant laws and regulations and to conduct the environmental review (relevant factor). The revised schedule will incorporate a quality assurance and technical review process that addresses the poor quality of the work products provided by the third-party contractor (TPC). USACE and CPRA have been working together to address these issues with the TPC. To rectify these issues, the following has been added: (1) weekly meetings to better track work activities and provide a more informal forum for the TPC to ask questions and discuss issues; (2) more TPC staff to fill the various roles/responsibilities that have been lacking; and (3) additional professional resources (supplemental contractors) to conduct quality assurance and technical review of the TPC’s work products.  This is a complex EIS that requires a certain level of quality assurance and technical review to ensure the document is accurate, consistent, and easily readable by the public. Previously, those activities were not sufficient. However, the added actions described in the paragraph above will ensure that USACE will have a good quality environmental document to utilize in making an informed permit and permission decision.

The United States Army Corps of Engineers (USACE), on behalf of the Coastal Protection and Restoration Authority, (Applicant/Project Sponsor), is requesting time extensions for all the planned and in-progress target milestone dates on the permitting dashboard for the Applicant’s Mid-Breton Sediment Diversion project.  This revised schedule is due to the Applicant’s change in the design of the Applicant’s preferred alternative (APA) from 75,000 cubic feet per second (cfs) to 50,000 cfs in November 2021.   The revised schedule shifts most milestones to the right by approximately 12 months.  USACE is also requesting additional time between the publication of the Notice of Availability of the Final EIS and the issuance of the Record of Decision (ROD), based on lessons learned from the preparation and finalization of the DEIS and FEIS and the processing of DA permit and permission requests by the same Applicant for the Mid-Barataria Sediment Diversion.  In addition, the revised schedule provides sufficient time to complete and achieve compliance with applicable environmental law and regulations, including a 30-day public review of the FEIS and USACE consideration of all public comments, as well as the production of the USACE decision documents, and the execution of the ROD at District and Division levels.
