The proposed action may take birds
Description
The Migratory Bird Treaty Act makes it illegal for anyone to take any migratory bird or nests, or eggs of such a bird except under the terms of a valid permit issued pursuant to Federal regulations. The migratory bird species protected by the Act are listed in 50 CFR 10.13. Take means to pursue, hunt, shoot, wound, kill, trap, capture, or collect, or attempt to pursue, hunt, shoot, wound, kill, trap, capture, or collect. Take incidental to an action (non-purposeful take) is not permitted.
