USACE initiated Section 106 consultation with the Virginia SHPO and seven Tribal THPOs on June 9, 2026, 60 days prior to the scheduled ‘Section 106 consultation concluded’ milestone complete date. In coordination with the SHPO, USACE was able to successfully resolve the Virginia SHPOs concerns and the SHPO provided a letter concurring with the ‘no adverse effect’ determination on August 12, 2026. Two Tribal THPO’s responded to the request on June 17, 2026 and July 16, 2026, and the remaining four Tribal THPOs did not reply by the requested suspense date for comments, and USACE presumed concurrence on July 9, 2026., basic_html
