BOR continues to coordinate with the Project Proponent (Navajo Nation Broadband Office) and applicant (Sacred Wind Communications) to complete this milestone. A consent agreement was provided to the applicant for signature for the Use Authorization on 6/25. The applicant indicated that they had concerns with some of the conditions that were included in the consent agreement and requested a meeting. On 6/26, BOR requested a markup of the areas of the consent agreement where the applicant has concerns. To date, those concerns have not been identified, and the consent agreement has not been signed by the applicant. BOR legal staff will meet with the applicant's legal team to discuss their concerns on 7/7. Adjusting the milestone target date to allow time for legal discussion and resolution before the Use Authorization can be revised, reviewed, agreed upon, and finalized. These date changes have been coordinated with the Project Proponent and applicant prior to posting to the Dashboard.       , basic_html

This extension would allow the proponent time to submit required documentation (survey plats and Joint Use Agreement/Permits for ROW). A detailed survey plat and legal description of where the proposed right of way will be within the existing easements are necessary, to ensure accuracy and to show that all the requirements of the legal description have been met.
