Vineyard Offshore has requested to extend the EPA OCS air permit by 12 months to better align the OCS air permit schedule with the Project design and construction schedules. EPA regulations require construction to start within 18 months of the effective date of the permit, which if issued around the COP approval does not allow sufficient time for design completion and the start of construction. Extending the permitting schedule now thus mitigates the need to seek a permit modification.  EPA’s OCS air permits are not subject to the National Environmental Policy Act (NEPA) and therefore are not dependent on the NEPA schedule. However, EPA’s OCS air permit does rely on ESA, MSA and NHPA determinations including mitigation made during the permitting process and included in the ROD.  Under the revised schedule, EPA OCS air permit approval would occur after these determinations and ROD have been completed. , basic_html

The OCS Air Permit milestones are dependent on BOEM's EIS action milestones. With the shift in the Record of Decision (ROD) date, EPA will accordingly extend the milestone date for issuance of final decision/permit approval of the OCS Air permit.
