USACE received a request for a Department of the Army Permit on September 28, 2023.
The Corps requires that applicants consider and use all reasonable and practical measures to avoid and minimize impacts to aquatic resources. If the applicant is unable to avoid or minimize all impacts, the Corps may require compensatory mitigation. The applicant has proposed to pursue mitigation approaches which may consist of either mitigation banking or “in lieu fee,” in which any such mitigation approaches would be developed in coordination with federal agencies. In any case, unavoidable impacts to aquatic resources, and resulting adverse effects to the aquatic environment, would be offset via compensatory mitigation and would comply with the 2008 Mitigation Rule.
