Initially, the USFS served as the Lead Agency for this project. At the time, it was believed that the pipeline would be confined exclusively to federal lands administered by USFS. However, recent findings have revealed that the pipeline would be crossing onto US Army Corps Fee Land. As a result, the jurisdiction for pipeline permitting was transferred to BLM, in accordance with 43 CFR 2881.11.
