Under Section 7 of the Endangered Species Act, Federal agencies must consult with the U.S. Fish and Wildlife Services when any action the agency carries out, funds, or authorizes (such as through a permit) may affect a listed endangered or threatened species. A section 7 consultation is not a permitting activity and it is up to the federal action agency to include the time needed for consultation within its overall approval/authorization timeline. The purpose of the consultation is to assist the action agency in meeting its duty to insure that its action is not likely to jeopardize the continued existence of any listed species or result in the destruction or adverse modification of designated critical habitat. Upon completion of consultation the Service provides the action agency with either a letter of concurrence that the proposed project is not likely to adversely affect any listed species (meaning that no incidental take is anticipated) or a biological opinion.
