The Clean Water Act (CWA) requires that Federal Action agency's ensure compliance within states jurisdiction of subject statute to ensure sustainable natural resources (aquatic in this case). Acquisition of certification (WQC) was accomplished via collaboration and partnering with affected states to obtain "umbrella" authorization to proceed with the overall project. Subsequent certification/permitting for each construction contract is required and is tailored to that specific contact.

Request Sediment HARS Sampling and Testing Plan from USEPA Department of Defense Tom Shea 07/30/2012 Complete

Prior to the placement of any dredged material at the Historic Area Remediation Site (located about 6 miles off Sandy Hook, NJ in the Atlantic Ocean), the material must be sampled and tested to be sure that it meets the stringent requirements required by the USEPA. Prior to sampling and testing, a draft plan is developed by USACE that identities where in the channel samples will be taken based on historic dredging and contamination sources. This draft plan is then submitted to the USEPA for approval. Once approved, the USACE conducts the sampling and sends the samples to testing laboratories for testing.

USACE and USEPA sign "Super Memo" for HARS Placement Department of Defense Bryce Wisemiller 05/28/2013 Complete

The USACE and USEPA "Super Memo" is a joint document in which both agencies agree that the material that was sampled and tested for HARS placement meets all of the stringent requirements and that the material is suitable for the HARS. EPA reviews all of the test data and quality control documents prior to the signing of the memo.
